1 Scope and Contractual Partner
1.1 These General Terms and Conditions apply to orders placed via the online shop ZINKE at https://zinke.store.
1.2 The customer’s contractual partner is Pascal Zinke, trading as ZINKE, Mühlenbergstraße 66/1, 72160 Horb am Neckar, Germany

1.3 The offer is aimed exclusively at consumers within the meaning of § 13 BGB (German Civil Code) with a delivery address in Germany, Austria, Belgium, the Netherlands, Luxembourg, France, Spain, Italy, Portugal, Ireland, Greece, the Czech Republic, Hungary, Finland, Denmark, Sweden, or Poland. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities.
2 Formation of Contract
2.1 The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
2.2 The customer may add products to the shopping cart, check their entries before submitting the order, and amend them using the correction options provided during the ordering process. By clicking the final order button that clearly indicates the payment obligation, the customer submits a binding offer to conclude a purchase contract for the goods contained in the shopping cart.
2.3 An automatically sent receipt confirmation merely acknowledges receipt of the order, unless it expressly declares acceptance at the same time. ZINKE may accept the offer within five days by expressly declaring acceptance via email, requesting or processing payment, or shipping the goods. The first point in time at which one of these events occurs is decisive. If the offer is not accepted within this period, the customer is no longer bound; payments already received will be refunded without delay.
2.4 The contract languages are German, Dutch, French, Spanish, Danish, Swedish, Finnish, and Polish. In Belgium, Italy, Portugal, Ireland, Greece, the Czech Republic, and Hungary, the shop is currently provided in German; the contract language there is German. The language in which the customer placed the order is decisive. If the language versions of these terms differ, the German version shall prevail, provided this does not conflict with mandatory consumer protection regulations.
2.5 ZINKE stores order data in accordance with statutory obligations. The customer receives the order information and the contract texts applicable at the time of contract conclusion with the confirmation email in a storable form or as downloadable documents. If a customer account is used, order data can be viewed there. The customer can also save the order confirmation themselves.
3 Prices, Shipping Costs, and Discounts
3.1 All prices stated in the shop are total prices. In Germany, Austria, Belgium, the Netherlands, Luxembourg, France, Spain, Italy, Portugal, Ireland, Greece, the Czech Republic, Hungary, and Finland, they are shown in Euros; in Denmark, Sweden, and Poland, they are shown in the respective local currency. The total amount shown at checkout is decisive. Due to the small business regulation pursuant to § 19 UStG (German Value Added Tax Act), no VAT is shown.
3.2 In addition to the price of the goods, shipping costs as shown before the order is placed will apply. The amount of shipping costs and the threshold for free shipping depend on the country of delivery; the value of the goods after deduction of discounts is decisive. The following apply per order: Germany 5.99 EUR, free shipping from 65.00 EUR; Belgium, Netherlands, France, Spain, Italy, Portugal, Ireland, Greece, Czech Republic, and Hungary 9.99 EUR, free shipping from 65.00 EUR; Austria and Luxembourg 9.99 EUR, free shipping from 69.00 EUR; Finland 9.99 EUR, free shipping from 75.00 EUR; Denmark 79.00 DKK, free shipping from 549.00 DKK; Sweden 119.00 SEK, free shipping from 849.00 SEK; Poland 49.00 PLN, free shipping from 299.00 PLN. In Denmark, Sweden, and Poland, the stated amounts apply directly in the respective local currency and are not a conversion of a Euro amount. Details can be found under Shipping and Payment. An express shipping method is currently not offered.
3.3 No further import duties, customs duties, or handling fees will be charged to the customer upon delivery. Should a carrier demand such payment contrary to this agreement, the customer should not pay without verification and should contact ZINKE immediately.
3.4 Discount codes apply according to the terms published. A cash payment is excluded. Unless otherwise stated, only one discount code can be redeemed per order. Statutory rights of the customer remain unaffected.
4 Payment
4.1 The payment methods available for an order are displayed no later than at the beginning of the ordering process and again before the order is submitted.
4.2 Unless otherwise stated for the chosen payment method, the purchase price is due upon conclusion of the contract. The terms of the payment service provider selected at checkout may also apply to the payment processing; the customer’s statutory rights against ZINKE remain unaffected.
5 Delivery
5.1 Delivery is made exclusively to delivery addresses in Germany, Austria, Belgium, the Netherlands, Luxembourg, France, Spain, Italy, Portugal, Ireland, Greece, the Czech Republic, Hungary, Finland, Denmark, Sweden, and Poland.
5.2 The total delivery time applicable to the respective product is displayed on the product page or, at the latest, before the order is submitted. It includes the usual processing and transport time. Different delivery times may apply if multiple products are ordered.
5.3 Goods may be shipped directly by commissioned production, warehouse, or logistics partners. An order may arrive in multiple shipments if this is reasonable for the customer. This does not result in additional shipping costs for the customer. Regardless of the shipping method, ZINKE remains the contractual partner and the contact for delivery, cancellation, and warranty claims.
5.4 If an indicated delivery time cannot be met as an exception, ZINKE will inform the customer immediately about the delay and the expected new delivery time. Statutory rights of the customer remain unaffected.
5.5 For consumers, the risk of accidental loss or accidental deterioration of the goods only passes upon delivery of the goods to the customer or to a third party authorized to receive them designated by the customer.
6 Retention of Title
The delivered goods remain the property of ZINKE until full payment has been made.
7 Right of Withdrawal
Consumers are entitled to the statutory right of withdrawal. Details can be found in the separate Cancellation Policy and the model withdrawal form.
8 Statutory Warranty
8.1 The statutory warranty law applies. An additional guarantee exists only if it has been expressly promised for the specific product in text form.
8.2 In the event of damaged, incorrect, or defective goods, the customer should contact ZINKE as soon as possible at info@zinke.store and, if reasonable, provide photos as well as the order number. This is not a prerequisite for the customer’s statutory rights.
9 Liability
9.1 ZINKE is liable without limitation for intent and gross negligence, for damages resulting from injury to life, body, or health, according to the Product Liability Act, and in all other cases of mandatory statutory liability.
9.2 In the event of a slightly negligent breach of a material contractual obligation, liability is limited to the damage foreseeable at the time of contract conclusion and typical for the contract. Material contractual obligations are duties whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the customer may regularly rely.
9.3 Otherwise, liability for slight negligence is excluded. The above limitations also apply in favor of ZINKE’s legal representatives and vicarious agents.
10 Consumer Dispute Resolution
ZINKE is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
11 Final Provisions
11.1 German law applies, excluding the UN Sales Convention. For consumers, this choice of law only applies insofar as they are not deprived of the protection afforded by mandatory provisions of the state of their habitual residence.
11.2 For consumers, the statutory places of jurisdiction apply. No exclusive jurisdiction agreement is made.
